Terms of Service

These Terms of Service form the agreement between Onyx Gym Kenya and every member, prospective member, guest, visitor, payer, purchaser, class participant, personal training client, event attendee, website user, guardian, parent, corporate account representative, and any other person who registers for, pays for, accesses, attends, uses, books, purchases, receives, or attempts to receive services, facilities, products, content, memberships, classes, promotions, trials, communications, or support from Onyx Gym. By using any Onyx Gym service, the user confirms that they have read, understood, and accepted these Terms in full.

1. Membership, Eligibility, Access, and Account Responsibility

Membership access begins on the start date confirmed at purchase, activation, renewal, or approval and continues only for the plan, duration, branch access, benefit level, class allocation, guest privilege, trainer allocation, and service category purchased or otherwise approved by Onyx Gym. Members must provide accurate, current, and complete registration, contact, emergency, billing, health-related, and identification information where requested and must promptly update such information when it changes. Onyx Gym may refuse, delay, suspend, cancel, restrict, or terminate access if information is inaccurate, incomplete, misleading, unverifiable, fraudulent, outdated, unsafe, inconsistent with facility requirements, or otherwise unsuitable for providing services.

Members and guests are responsible for all activity connected with their accounts, bookings, access credentials, membership cards, QR codes, check-in details, payment confirmations, and communications. Access credentials may not be transferred, sold, shared, duplicated, lent, assigned, sublicensed, or used by another person unless Onyx Gym expressly allows it in writing. Onyx Gym may require identity checks, account verification, photographs, signatures, waivers, health declarations, or staff approval before allowing entry, participation, renewal, plan changes, class attendance, trainer sessions, promotional use, or guest access. A member may not claim benefits that are not included in their active plan, have expired, were issued in error, were obtained through unauthorized use, or are subject to conditions not yet satisfied.

2. Payments, Renewals, Refunds, Freezes, and Promotions

Fees, charges, deposits, joining fees, subscriptions, class fees, trainer fees, retail purchases, event fees, administrative charges, and any other amounts are due at the time stated during purchase, invoicing, renewal, booking, or confirmation. Payments may be made through supported methods including M-Pesa, cards, bank transfers, cash where accepted, vouchers, credits, or other approved channels. Access is not guaranteed until payment is received, verified, allocated, and accepted by Onyx Gym. Failed, reversed, disputed, partial, delayed, duplicated, misallocated, suspicious, or chargeback payments may result in access suspension, cancellation, administrative review, repayment obligations, or other account restrictions.

Membership fees are generally non-refundable unless required by applicable law or expressly approved by Onyx Gym. Refunds, credits, extensions, plan freezes, upgrades, downgrades, transfers, pauses, cancellations, and promotional adjustments are subject to Onyx Gym policy, plan rules, eligibility, documentation, administrative approval, and operational feasibility. Promotions, discounts, trials, referral rewards, corporate rates, seasonal offers, and bundled benefits may be limited by date, branch, membership type, stock, booking availability, eligibility, usage limits, and other conditions. Onyx Gym may correct pricing errors, payment errors, benefit errors, technical errors, mistaken confirmations, or promotional misuse at any time, including after checkout, where reasonably necessary.

3. Facility Rules, Safety, Health, Conduct, and Assumption of Risk

Users must follow all staff instructions, posted rules, safety notices, booking policies, opening hours, hygiene standards, equipment guidelines, class rules, trainer directions, capacity limits, age restrictions, dress requirements, and conduct expectations. Users must treat staff, trainers, contractors, members, guests, and visitors with respect and may not engage in harassment, intimidation, threats, abusive language, discrimination, violence, theft, vandalism, unsafe lifting, improper equipment use, unauthorized coaching, commercial activity, filming without permission, recording in restricted areas, disruption of classes, entry into staff-only areas, intoxication, illegal activity, or any conduct that Onyx Gym considers unsafe, unlawful, offensive, harmful, disruptive, or inconsistent with the facility environment.

Exercise, training, classes, sauna use, recovery services, equipment use, and other fitness-related activities involve inherent risks including injury, illness, aggravation of existing conditions, falls, collisions, overexertion, dehydration, muscle soreness, equipment malfunction, and in rare cases serious injury or death. Each user is responsible for assessing their own health, ability, limitations, medical conditions, medications, pregnancy status, recovery status, and fitness level before participating. Users should consult a qualified healthcare professional before beginning or changing exercise programs where appropriate. Onyx Gym staff may provide general fitness support, but such support is not medical advice, diagnosis, treatment, physiotherapy, or nutrition therapy unless expressly provided by a licensed professional acting within their scope.

4. Classes, Bookings, Trainers, Digital Services, and Availability

Class schedules, trainer availability, facility hours, equipment availability, branch access, retail stock, events, amenities, and service offerings may change without prior notice due to maintenance, staffing, demand, holidays, private bookings, safety issues, renovations, supplier interruptions, technical issues, power interruptions, weather, public health requirements, emergencies, government directives, or other operational reasons. Bookings may be required for certain classes, trainers, events, or services and may be subject to cancellation windows, no-show rules, waitlists, capacity limits, late-entry rules, eligibility requirements, and account standing. Onyx Gym may cancel, combine, reschedule, substitute, relocate, shorten, or modify classes, trainers, events, amenities, or services where reasonably necessary.

Website content, booking tools, payment flows, account pages, messages, notifications, class descriptions, pricing displays, promotional materials, schedules, availability indicators, and digital features are provided for convenience and may contain errors, delays, omissions, interruptions, outdated details, or third-party dependencies. Onyx Gym may update, remove, suspend, restrict, replace, or discontinue any digital or physical service feature at any time. Users may not interfere with website security, scrape content, attempt unauthorized access, misuse forms, submit malicious code, impersonate another person, manipulate payments, or use Onyx Gym systems for unlawful, commercial, abusive, or unauthorized purposes.

5. Liability, Personal Property, Changes, Termination, and General Terms

To the fullest extent permitted by law, Onyx Gym, its owners, directors, employees, trainers, contractors, service providers, payment partners, affiliates, representatives, and agents are not liable for indirect, incidental, special, consequential, punitive, exemplary, or loss-of-profit damages, nor for loss, theft, damage, or misplacement of personal property brought into the facility, lockers, parking areas, reception areas, studios, changing areas, or other spaces. Users are responsible for securing their belongings and should not bring valuable items into the facility. Nothing in these Terms excludes liability that cannot lawfully be excluded, and any required statutory rights remain unaffected.

Onyx Gym may suspend or terminate access, refuse renewal, cancel bookings, revoke benefits, require a user to leave the premises, or restrict future participation where a user breaches these Terms, violates facility rules, fails to pay, misuses services, behaves unsafely, creates a risk to others, damages property, engages in fraud, disrupts operations, or otherwise acts in a manner Onyx Gym considers unacceptable. These Terms may be updated periodically to reflect changes in services, pricing, policies, operating requirements, legal obligations, or business needs. Continued use after updated Terms are posted or communicated means the user accepts the revised Terms. If any provision is invalid or unenforceable, the remaining provisions continue in effect. These Terms are governed by the applicable laws of Kenya, subject to mandatory consumer protections and any dispute process required by law.
